Terms of Service

1. Eligibility

The App is available only to current students, staff, and affiliates of the University of California, Berkeley who hold a valid @berkeley.edu email address. By using the App, you represent and warrant that you meet this requirement. The App is an independent project and is not affiliated with, endorsed by, or operated on behalf of UC Berkeley.

2. Accounts and Authentication

To use the App, you must sign in through Google OAuth with your @berkeley.edu email address. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You may not transfer, sell, or otherwise share your account access.

3. Acceptable Use

You agree to use the App only for lawful purposes. Prohibited conduct includes, but is not limited to:

• Uploading or sharing content that is pornographic, sexually explicit, or graphically violent.
• Posting hate speech, harassment, threats, or discriminatory content.
• Impersonating others or misrepresenting your identity.
• Introducing malware or other harmful code.
• Attempting unauthorized access to any part of the App or its systems.

We reserve the right to remove content, suspend accounts, or take other appropriate measures if these Terms are violated.

4. User Content

Reviews and ratings you post are attributed to your account and are not anonymous. You retain ownership of your submissions but grant Berkeleyum a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App. You are solely responsible for any content you submit and acknowledge that your reviews reflect your own views, for which you bear full liability.

5. Intellectual Property

All rights, title, and interest in the App, including its design, code, and branding, belong to Berkeleyum or its licensors. You may not copy, modify, distribute, or create derivative works from the App without written permission.

6. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or if continued access presents risk to the App or its users. You may discontinue use of the App at any time by ceasing access.

7. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, secure, or uninterrupted. Your use of the App is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Berkeleyum and its developers shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the App or user-submitted content.

9. Indemnification

You agree to indemnify and hold harmless Berkeleyum, its developers, and affiliates from and against any claims, liabilities, damages, or expenses resulting from your use of the App or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of California. Any disputes will be resolved in the state or federal courts located in Alameda County, California.

11. Modifications

We may update these Terms from time to time. The "Last Updated" date will reflect the most recent version. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
